- What further steps can be taken by parties, their legal representatives and arbitral tribunal’s to reduce the length and cost of proceedings ?
Managing conflicts – the arbitrator and counsel perspective
- Intro: When does the conflicts question arise?
- At the time of constitution of the Arbitral Tribunal
- But also while the proceedings are pending – so constant monitoring is needed (both from the arbitrator perspective and counsel perspective)
- What do we mean by “conflicts”?
- Reference to ICC Rules (independence and impartiality of arbitrators)
- Reference to the latest revision to the IBA Guidelines on Conflicts of Interest in International Arbitration (illustrations based on green, orange and red lists)
- How to manage conflicts when they arise?
- From the arbitrator perspective:
- Need to have comprehensive conflicts check system (make sure that all parties, counsel, witnesses and experts are considered)
- That the system monitors for conflicts while the case is pending
- Whether certain disclosures are necessary and/or advisable? For ex. where counsel is co-arbitrator in a different case
- From the counsel perspective:
- How to behave when arbitrator conflict is perceived – challenges to arbitrators under ICC Rules (procedure, etc).
- Avoid creating conflicts - reference to IBA Guidelines on Party Representation in International Arbitration

- Where should recognition and enforcement and, ultimately, execution of an award be sought against a recalcitrant party ?
